 2.Eligibility

 

To use our Services, you must meet the following eligibility requirements:

We do not knowingly collect personal information from children under the age of 18, in compliance with the Children’s Online Privacy Protection Act (COPPA). If we discover that a child under 18 has provided us with personal information, we will take steps to delete such information.
• Parental Consent: If you are under 18, you represent that you have received consent from your parent or guardian to use the Services and to engage in any in-game activities, including those involving financial transactions or prize eligibility.

You further affirm that you:

• Are legally capable of entering into binding contracts.
• Are not located in a jurisdiction where participation in skill-based gaming is prohibited or restricted.Restricted territoriesare as follows: Delaware, Louisiana, Maryland, Montana, Tennessee, Indiana, Maine, Texas.

 

3.Account Creation and Responsibilities

 

To access certain features of the Services, you may need to create an account. When you create an account, you agree to provide truthful and accurate information, including your email address, date of birth, username, and any other information required. You agree to keep this information up to date, as we may rely on it to deliver game services and communications to you.

 

Your account is personal to you, and you are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately if you suspect any unauthorized access or activity under your account.

 

You are solely responsible for all activity that occurs under your account, whether authorized or not, and agree to hold CLEVER CLASH INC harmless for any loss or damage resulting from unauthorized access to your account.

CLEVER CLASH INC grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use. This license is subject to these Terms and may be revoked if you violate any provision of these Terms.

You agree not to:

• Engage in any fraudulent activity or use these games for any unlawful purposes.
• Use cheats, bots, or other unauthorized tools to gain an advantage in these games.
• Exploit these games or Services in a manner that violates our community guidelines or any applicable laws.

 

Any unauthorized use or violation of these Terms may result in the suspension or termination of your account and access to the Services.

 

 5.User Conduct

 

While using the Services, you agree to comply with all applicable laws and regulations, and you specifically agree not to engage in the following prohibited conduct:

• Harassment and Abuse: Posting or transmitting offensive, obscene, or threatening content. Engaging in harassment, hate speech, or defamation towards other users or staff members.
• Cheating or Fraud: Using any cheating methods, hacks, bots, or software to gain an unfair advantage in these games. Engaging in fraudulent activities or exploiting bugs within these games.
• Illegal Activities: Engaging in any illegal activities while using the Services, including but not limited to fraud, money laundering, or unauthorized use of payment methods.
• Interference with Services: Attempting to interfere with, disrupt, or harm these games servers or infrastructure in any way.

 

We reserve the right to suspend or terminate your account for engaging in any of the above behaviors or for violating these Terms of Service, which may be updated from time to time.

 

 6.Skill-Based Competitions and Prizes

 

CLEVER CLASH INC is a skill-based game, and competitions within these games are determined by your gaming ability and not by chance. By participating in skill-based competitions, you acknowledge that the outcomes are based on your skills, experience, and performance.

• Entry into Competitions: Participation in skill-based competitions may involve the use of virtual currency or real money for entry. However, you are not required to pay money to participate in skill-based competitions unless you choose to do so. In some cases, you may also enter competitions using virtual rewards or free entries.
• Prizes: Prizes awarded in competitions are based on your performance. Prizes may include in-game currency, virtual items, or tangible goods. Prize details and eligibility criteria will be disclosed in each competition's rules.
• No Chance Involved: Our competitions are not games of chance. Winners are selected based on their skills and performance in these games. We comply with all applicable state and federal regulations regarding skill-based gaming.

 

7.In-Game Purchases and Virtual Currency

 

The Services may offer virtual currency, in-game items, or other digital goods for purchase. All in-game purchases are final and non-refundable unless required by law.

• Virtual Currency: You may purchase virtual currency with real-world money, which can be used for in-game purchases, including entry into skill-based competitions. This virtual currency holds no monetary value outside of these games and cannot be redeemed for real-world currency.
• Payment Methods: All payments are processed through third-party payment providers, which will handle your financial transactions securely.

You agree to abide by any additional terms or restrictions related to in-game purchases, as displayed within these games or during the checkout process.

  

8. Winnings, Account Funds, and Payments

 

8.1. Cash Deposits

"Non-Cash Players" may participate in competitions without depositing U.S. Dollars.

"Cash Players" must deposit U.S. Dollars to enter fee-based competitions and are required to maintain accurate and up-to-date account information (including full name, address, phone number, and payment details).

By becoming a Cash Player, you consent to the sharing of your personal and payment information with third-party service providers for identity verification, transaction risk assessment, and other purposes described in our Privacy Policy.

 

8.2. Bonus Funds

Cash Players may receive "Bonus Funds" for use in cash competitions. These funds are non-withdrawable.

Bonus Funds are accrued at a rate of $0.01 for every $0.10 spent on entry fees.

If Bonus Funds are available, they will be used first toward entry fees. Winnings earned from entries that used Bonus Funds will return the Bonus Funds amount to your account, with any additional winnings paid in U.S. Dollars.

Bonus Funds will be forfeited if:

You withdraw funds from your Account;

You do not enter any cash competition for 60 consecutive days.

 

8.3. Withdrawals

Cash Players may request withdrawals of available U.S. Dollar balances. Digital Assets and Bonus Funds are not eligible for withdrawal.

Withdrawals are processed either by check or through a refund to the original payment method and may take up to 90 days to complete.

We reserve the right to freeze your account or delay withdrawal requests during the investigation of suspected abuse, eligibility verification, or to comply with applicable laws.

A processing fee of up to $2 may apply for check withdrawals under $10.

 

8.4. Refund Policy

All entry fees and deposits are final. No refunds will be issued unless required by law.

 

8.5. Winnings

To receive winnings, you may be required to provide proof of eligibility and confirm your compliance with these Terms.

Failure to provide satisfactory documentation will result in the forfeiture of winnings.

Any erroneous credits or overpayments are subject to reversal, and we may deduct overpaid amounts from future payments.

 

8.6. Use of Credit Cards / PayPal

You must be the authorized owner of any credit card or payment method (e.g., PayPal account) used on the platform.

You are responsible for promptly notifying us of any changes to your payment information.

Unauthorized use of payment methods is prohibited, and you will be held liable for any fraudulent activity.

Engaging in fraudulent behavior will result in immediate account termination, forfeiture of all winnings, and may lead to legal action.

 

9. Privacy Policy

 

Your privacy is important to us. We collect, use, and protect your personal information as described in our Privacy Policy. By using the Services, you consent to the practices outlined in the Privacy Policy, including our collection of personal data, use of cookies, and sharing of data with third-party service providers.

We take all reasonable steps to safeguard your data, including encryption, secure servers, and regular security audits. However, no system is completely secure, and we cannot guarantee the absolute security of your data.

 

10. Intellectual Property

 

All content available through the Services, including but not limited to these games itself, software, graphics, logos, designs, text, audio, video, music, in-game assets, virtual goods, and any other materials (collectively, the "Content"), are owned by CLEVER CLASH INC, our affiliates, licensors, or partners, and are protected by applicable intellectual property laws, including copyright, trademark, patent, and trade secret laws, as well as international treaties.

 

By using the Services, CLEVER CLASH INC grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Content solely for personal, non-commercial use within the context of the Services. This means you may use the Content only to play these games, view the website, or use the mobile applications as intended by CLEVER CLASH INC.

 

You may not:

• Copy, reproduce, or distribute the Content, in whole or in part, through any medium (including but not limited to print, video, or digital forms), unless expressly permitted by us in writing.

CLEVER CLASH INC reserves the right to pursue any remedies available under law, including injunctive relief and claims for damages.

 

By using the Services, you also agree to respect the intellectual property rights of other users. Any user-generated content that violates intellectual property laws or the rights of other users is prohibited, and we may remove such content and take appropriate action, including account suspension or termination.

 

11. Dispute Resolution and Arbitration

 

These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

 

In the event of a dispute between you and CLEVER CLASH INC, we encourage you to contact us to resolve the issue informally. If the dispute cannot be resolved informally, you agree to submit to binding arbitration under the rules of the American Arbitration Association. This means you waive your right to a trial by jury or to participate in class actions.

 

The parties expressly waive any right to participate in a class action or representative proceeding. All claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

 

The arbitration will be held in the jurisdiction where CLEVER CLASH INC is based, and you agree to bear the cost of arbitration unless the law requires us to bear the costs.

 

12. Termination and Suspension

 

We may suspend or terminate your account at any time, for any reason, including if we believe you have violated these Terms or engaged in misconduct. Upon termination, your access to the Services will be revoked, and we may retain your data as required by law.

 

13. Limitation of Liability

 

To the fullest extent permitted by applicable law, CLEVER CLASH INC and its affiliates, subsidiaries, employees, agents, and licensors shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of the Services. This includes, but is not limited to, any damages related to:

• Loss of profits: Any loss of revenue, profits, or anticipated savings arising from your participation in the Services or Competitions.
• Loss of data: Any loss, alteration, or corruption of your game data, personal information, or progress within these games.
• Loss of goodwill: Any loss of reputation, business opportunities, or goodwill arising from your use of the Services or participation in Competitions.
• Service interruptions: Any issues, disruptions, delays, or errors in the operation of the Services, whether caused by technical failures, system outages, or other unforeseen circumstances.
• Third-party actions: Any claims or losses related to third-party service providers, including payment processors, who may be involved in processing your transactions.

 

We do not guarantee that the Services will be error-free, and uninterrupted, or that the system will meet your expectations, including performance or accessibility levels. Any delays or failures in performance due to system or technical issues, including server downtime, are not considered breaches of these Terms.

 

In jurisdictions where such exclusions or limitations are not allowed, our liability shall be limited to the maximum extent permitted by applicable law. However, in no event will our total liability exceed the amount you have paid to participate in the Services in the six (6) months immediately preceding the claim.

 

By using the Services, you acknowledge and agree that CLEVER CLASH INC is not responsible for any damages that may arise from your participation in these games, including but not limited to competitive gameplay, transactions, or system failures.

 

14. Compliance with Laws

 

14.1. Restricted Areas

 

By using the Services, you acknowledge that certain states, countries, or jurisdictions have specific laws that govern contests, sweepstakes, and tournaments, particularly those involving prizes or entry fees ("Gaming Laws"). CLEVER CLASH INC does not allow participation in Cash Competitions from any jurisdiction where such Competitions are prohibited by law ("Restricted Jurisdictions").

 

As of the latest update, U.S. states such as Delaware, Louisiana, Maryland, Montana, Tennessee, Indiana, Maine, Texas, are restricted. It is your responsibility to confirm whether your location is subject to these restrictions. We may block access to our Services from Restricted Jurisdictions based on your location.

 

14.2. Legal Obligations

 

In addition to the Gaming Laws, you must also comply with all other applicable laws in your jurisdiction, including federal, state, and local regulations. If local laws prohibit your participation in any of our Competitions, then those Services are not available to you. You are responsible for ensuring that your use of the Services is lawful in your location.

We do not guarantee the legality of your participation in any Competition or use of the Services. By accessing the Services, you accept all responsibility for ensuring that your participation complies with the laws of your jurisdiction.
